FREEDOM OF MOVEMENT OF WORKERS – CHALENGE OF THE LEGISLATION OF THE EUROPEAN UNION AND REPUBLIC OF MACEDONIA

This paper provides analysis of the right of free movement of the workers within the European Union, as well as the general labor migration in Europe. Special emphasis is placed on the legal framework and acts of the European Union such as the Treaty establishing the European Economic Community; The European Social Charter and the Amsterdam Treaty, which among other, refear to the free movement of the workers, as one of the four freedoms enjoyed by the European Union citizens. The free movement is basis for the right of residence of the workers, the right of entrance and residence of their family members, as well as the right of work in any member-state and right of equall treatment just like the nationals of that member-state. This paper also contains the rights and obligations, which have been undertaken by Republic of Macedonia in relation to the free movement of the workers, with aim of harmonization of the national legislative to the legislative of the European Union, which is crucial for the process of integration of Republic of Macedonia to the European Union.
