KAJIAN YURIDIS TENTANG KORBAN PENIPUAN DALAM JUAL BELI ONLINE

This study aims to provide knowledge in the follow-up if there is a victim of fraud in online trading. The method used in this thesis is prescriptive doctrinal legal research. The approach used are the conceptual and legislation approach. Sources of legal materials used in this thesis are the primary legal materials and secondary legal materials, with legal materials analysis techniques using syllogisms and interpretation using deductive reasoning patterns. Based on this research, fraud in online trading is the same as usual frauds in general, the only differences are mean and toolused to commit acts of fraud, that are the internet and computer. Fraud regulated in the Criminal Code Article 378. In addition to fraud, author also examines the fencing when the buyer is a victim in the case of fraud but instead became a suspect in the case of fencing at customs. It (fencing) can not simply drop to the buyer (the victim) because of ignorance of the origin of the goods. Fencing regulated in Article 480 of the Criminal Code.
