TANGGUNG JAWAB HUKUM PERUSAHAAN PERTAMBANGAN PASCA TAMBANG DALAM PERLINDUNGAN DAN PENGELOLAAN LINGKUNGAN HIDUP (STUDI PADA PERUSAHAAN PERTAMBANGAN BATU ANDESIT PT. BATU ALAM PERSADA, PRINGSEWU, LAMPUNG)

This study described and examined the problems regarding the legal responsibility undertaken by PT. Batu Alam Persada in the mining area of environmental’s management and the reclamation and post mining’s programs in order to preserve the environment. This research was kind of empiric legal research which was descriptive. The primary data were obtained directly from the company and the community, while the secondary data included primary legal materials, secondary, and tertiary. Furthermore, the techniques of collecting data used were the study documents or library researchs and also interviews. The results showed that the legal responsibility of PT. Batu Alam Persada had been implemented in accordance with the constitution but had not been optimized yet. The Company had not been able to plan a community empowerment program which destined for the community around the mine area. The reclamation and post-mining’s obligation following the guarantee fund reclamation and post mining had been neglected and had nott been implemented yet. By neglecting the main obligations, the company violated the obligations which had been stated in the constitution. Therefore, Pringsewu’s District Government ought to take several action namely: written admonition, a temporaly suspension of the activities, or revocation of business licenses production operations in accordance with Article 50 Government Regulation Number 78 Year 2010 on Reclamation and Post Mining
