ANALISIS PENGARUH TRIAL BY THE PRESS TERHADAP INDEPENDENSI HAKIM

This legal writing explains the problems related to the influence of Trial By The Press on the independence of judges. The aim is to find out and analyze the qualifications of reporting that contain the element of Trial by The Press and to find out and analyze the influence of Trial by the Press on the Independence and Freedom of Judges. The research method used in this legal research approach is normative juridical method, juridically the writer will approach Law No. 40 of 1999 concerning the Press and Law No. 48 of 2009 concerning Judicial Power while Normatively that is the influence of Trial by the Press on the Independence of Judges. The technique of data collection is the technique of collecting legal material by the compiler using literature study. Literature study is an activity to collect information related to topics or problems that are the object of research that can be obtained from books, scientific papers, theses, dissertations and other written sources. Based on the results of research and discussion Public pressure that arises because of the news that falls in the practice of Trial by The Press cannot be taken into consideration in deciding a decision unless the urgency has been reviewed for compliance with existing laws and regulations. The independence of the judges themselves should not be influenced by the mass media or the news that appears when the case investigation process is in progress. In accordance with what has been stated above, the practice of Trial by The Press actually cannot affect the Independence of Judges
