ANALISA HUKUM KEBEBASAN PERS DALAM PROSES PERADILAN PIDANA ANTARA INDONESIA DAN INGGRIS

In early 2020, United Kingdom and Indonesian public were shocked by the news of Reynhard Sinaga, an Indonesian student of 190 rapes in a period of 2.5 years in the 2015-2017 period. One of the interesting things about this trial is that the media coverage of the case was only published simultaneously after the verdict was read out in January 2020, although the case has been tried since 2018 based on the order of the Manchester Crown Court. This thesis focuses on the analysis of the position of the press, judges and jury in the Indonesian and United Kingdom criminal justice system and the relationship of the principle of freedom of the press and the principle of presumption of innocence in the criminal justice system. This thesis research is a normative juridical research with literature study. The results showed that in contrast to the United Kingdom justice system which knew juries in certain criminal justice processes, the Indonesian criminal justice system did not recognize juries in its trial process. Both countries recognize the principle of freedom of the press, with some restrictions. In Indonesia, this freedom of the press is limited primarily to avoid trial by the press which sometimes overrides the principle of presumption of innocence that must be implemented for each defendant, as well as to maintain orderliness of the proceedings of the trial. This is different from in the UK, because it uses a jury system, one of the restrictions on press freedom in the form of delaying the reporting of the trial process can have a specific goal to preserve the presumption of innocence from the judges who judge the case
