Human Gene Editing — A Critical Approach to the Ethical and Legal Scene

Dissertação de Mestrado em Ciências Jurídico-Forenses apresentada à Faculdade de DireitoA edição do genoma humano tem sido um tópico muito discutido em anos recentes, por um lado resultado das descobertas e progresso que têm sido feitos ao nível científico, como, por exemplo, com a descoberta do sistema CRISPR-Cas9 que permite a atuação em genes previamente selecionados, e, por outro, devido aos resultados de experiências que estão a ser feitas no domínio científico, incluindo com o nascimento das gémeas Lulu e Nana, os primeiros seres humanos geneticamente editados. Acompanhando o debate social, emergem debates do foro ético e legal. Confrontando-se com o facto de que a edição genética já não é apenas uma questão teórica, mas sim uma realidade próxima, emergem questões sobre limites éticos, que requerem respostas sobre tópicos tais como o consentimento necessário para a intervenção em embriões, as repercussões de criar edições genéticas hereditárias e até que ponto é que será eticamente aceitável editar certas caraterísticas. Legalmente, não surgem apenas questões relacionadas como os limites deste tipo de intervenção, mas também uma verdadeira necessidade de regulação densa que garanta a estabilidade e segurança da utilização destas técnicas, de forma a criar um sentimento de confiança na sociedade. Apesar dessa necessidade, tal não se verifica, e ficamos, a nível nacional, ainda por uma legislação num estágio muito inicial e com uma atitude mais restritiva do que permissiva, verificando-se a mesma situação noutros países como os E.U.A., Itália e Alemanha. Há, no entanto, guidelines ao nível Europeu que pretendem dar início a esse novo tipo de regulamentação. Em conclusão, reforça-se o apelo à criação de uma regulamentação legal completa e exaustiva e de caráter mais liberal, que permita que permita colher os benefícios desta nova promessa científica.The editing of the human genome has been a highly discussed topic in recent years, on one hand a result of the discoveries and progress being made on a scientific level like, for example, the discovery of the CRISPR-Cas9 system that allows the targeting of previously selected genes, and, on the other hand, of the results of experiences being made in the clinical field, including the birth of twin sisters Lulu and Nana, the first genetically engineered human beings. Accompanying the social debate, legal and ethical debates emerge as well. Faced with the fact that genetic engineering isn’t just a theoretical matter anymore but a close reality, questions about the ethical boundaries arise that demand answers on topics such as the need for consent to intervene on embryos, the repercussions of creating hereditary genetic editions, and to what extend is it ethically acceptable to edit certain characteristics. Legally, not only do questions about limits of intervention emerge but also a true need for deeper regulation that guarantees a stable and secure approach to these techniques, as to create a sense of trust in society. Although there is an enormous need for a denser regulation that isn’t the current case of what is offered, and we stand, on a national level, in a very premature state of legislation that lies rather on the precautionary side than on the permissive one, which is also the scenario in other countries like the United States, Italy, and Germany. However, European guidelines exist that intend to serve as the basis for that new type of regulation. In conclusion, we underline the appeal for the need of creation of a complete and exhaustive legal framework with a more liberal agenda, that opens doors to the advantages of this new scientific promise
