PENGAWASAN KEMENTERIAN LINGKUNGAN HIDUP DAN KEHUTANAN DALAM RANGKA PEMBUKAAN LAHAN PERKEBUNAN KELAPA SAWIT SEBAGAI UPAYA PENCEGAHAN KERUSAKAN HUTAN

Nowadays, Oil Palm Plantations is a profitable industry for now. Many companies clean the area to open palm oil business. However they open the oil palm plantation by burning even though the government has prohibit land clearing by burn. The forest fire happened in Indonesia is not only become the national disaster, but also become an international disaster because of its smoke. The problems in this study are the surveillance of Environment and Forestry Ministry towards clearing oil palm plantations as an effort to prevent forest deforestation and also the obstacles and solutions of Environment and Forestry Ministry in controlling forest damage in the context of land clearing in Indonesia. This research is using legal empirical research. The data are obtained from some interview with respondents and sources information. The findings in this study are when doing the surveillance of prevention, the Environment and Forestry Ministry is not working by itself. It collaborates with other government agencies or non-government organization. The ministry has done the prevention of fire forest and it has been increased year by year. The conclusion of this research is the surveillance of Environment and Forestry Ministry has not optimally implemented yet. The author suggests that the Environment and Forestry Ministry needs to give the license holder strict sanction to companies who do not do their responsibility to make the report of forest and land fire control. They also need to coordinate with Agrarian and Spatial Planning Ministry in order to regulate the issuance of right in the forest area
