TINJAUAN YURIDIS TENTANG KEADILAN RESTORATIF TERHADAP ANAK PELAKU TINDAK PIDANA PEMBUNUHAN DI KEPOLISIAN DAERAH (POLDA) DAERAH ISTIMEWA YOGYAKARTA

Restorative justice is the settlement of a case by deliberation by emphasizing restoration to its original state. Restorative justice efforts in resolving criminal cases are regulated in the juvenile justice system Act with diversified forms. The research objective is to analyze a juridical review of the restorative justice process, so that it can find out how it applies to the child who committed the crime of murder. This study uses a normative legal method which focuses on positive law in the form of statutory regulations regarding the judicial review of restorative justice towards children who commit the crime of murder. The results of the study that the crime of murder especially fetal killings (abortion provokatus criminalis) can be sought restorative justice as regulated in the juvenile criminal justice system with the provisions of the age of the child when committing a crime and a criminal threat of less than seven years and is not a repeat of the criminal act. In its Implementation, after an agreement is reached between the perpetrators, parents / guardians, and related parties, the outcome of the agreement requires the determination of the district court and the results of the agreement in the form of submission to parents / guardians, participation in education or training in educational institutions or LPKS ( institutions for implementing social welfare), and community service
