PENGATURAN HUKUM TENTANG TINDAKAN PENGHINAAN CITRA TUBUH (BODY SHAMING)

Technological defelopments at this time are very fast causing new crimes to appear such as crimes of bodily insults commited through social media as facebook, twitter, instagram, whatsaap and so forth. The regulation of the crime of insulting body image is currently using article 27 paragraph 3 of information law and electronic (UU ITE) transactions by referring to article 315 of the criminal law (KUHP).It means that if the body image insulting act is carried out using social media means the culprit is charged under article 27 paragraph 3 UU ITE, and if the body image insulting act is carried out directly in front of that person then the culprit is charged with article 315 KUHP with mild insult status, and insulting crime this body image is offensive to complaint.
