INTERPRETATION AND DEMOCRATIC DIALOGUE

This article deals with constitutional interpretation by discussing the meaning of the Constitution and who should be responsible for its interpretation. Although some believe the ideal constitutional interpretation is the one resulting from a collective process, which covers the institutional issue of who would have the authority to make such an interpretation, it is very common to treat such matters separately, and this is how the matter will be discussed in these pages – first, bringing to scene the problems related to the dominant interpretive strategies and, further on, discussing the issue of authority for constitutional interpretation.Este artigo trata da interpretação constitucional, discorrendo sobre o significado da Constituição e sobre quem deve ser responsável por sua interpretação. Embora alguns acreditem que a interpretação constitucional ideal é aquela resultante de um processo coletivo, o qual abrange o tema institucional sobre quem teria a autoridade para fazer tal interpretação, é muito comum o tratamento de tais assuntos separadamente, e esta é a forma como a matéria será discutida nestas páginas – primeiramente, trazendo-se à cena os problemas relacionados com as estratégias interpretativas dominantes e, mais à frente, discutindo-se a questão da autoridade para a interpretação constitucional
