Dampak Kebijakan Kontroversial (RUU KUHP) yang Dibuat oleh Pemerintah terhadap Rasa Bela Negara Mahasiswa

The controversy over criminal law enforcement based on the Criminal Procedure Code is due to law enforcement still struggling in the formalism paradigm, so many cases just evaporate because of limited thinking about the implementation of law enforcement. controversy occurs as long as law enforcement officials do not change the idea that the main purpose of criminal law enforcement is to bring about truth and justice. Controversy is not only on the aspect of criminal law enforcement but also on the policy of drafting the Bill and the Criminal Code Act which is discussed and ratified at the end of the term of office. A series of articles in the Criminal Code Bill invite a lot of controversy from various walks of life in Indonesia including students. Students in various regions in Indonesia held a demonstration in front of the pages of their respective regional DPR offices to demand the cancellation of several points of the Criminal Code Bill that were considered unreasonable and only benefited certain parties. The purpose of this article is to describe how the impact of the controversial policy (RUU KUHP) made by the government on the defense of a student state. From the results of the discussion it was concluded: 1) Government policies should side with the people, because in fact the government of democracy is the people, by the people and for the people. 2) The main objective of law enforcement is to realize truth and justice. As long as law enforcers do not change the idea that the main purpose of criminal law enforcement is to bring about truth and justice, the implementation of the Criminal Procedure Code will continue to cause controversy. 3) The bill discussed and the law passed at the end of the term of office of members of the council caused a controversy, and invited many controversies from various walks of life in Indonesia including the students who, for reasons of defending the country, simultaneously demanded the cancellation of several points of the Criminal Code Bill which were considered unreasonable and benefit certain parties. 4) Rejection of students under the pretext of defending the country by exercising democratic control through demonstrations of the rejection of the controversial policy of the Criminal Code Bill is indicated to be ridden by various interests so that in the future democratic control must truly carry out its functions, not become an economic commodity such as paid demonstrations, with demands being voiced only in the interests individuals and groups of people
