Consumer protection in finance

The thesis is based on my bachelor thesis written on the same topic and defended in 2016. Individual parts will be elaborated further and the thesis will be focus on new legislation of this legal area, as well as on relevant oversight authority, supervisory body, and protection authority. Terms related to the given area will be defined and also there will be an insight into the history of loans and consumer loans in our country. Legislation in force will be emphasized, including its application in practice. The basic types of loans, their requirements, and a public protection law will be mentioned. Simultaneously, conditions and requirements of arbitration proceedings will be stated. Furthermore, the thesis deals with enforcement and insolvency proceedings, which are closely related to consumer protection in finance. The views on this issue will be compared with the views of courts of various levels.Tato práce vychází z mé bakalářské práce napsané na stejné téma a obhájené v roce 2016. Jednotlivé pasáže budou podrobněji rozvedeny a práce se bude věnovat nové právní úpravě této oblasti, jakož i příslušným orgánům dozoru, dohledu a ochrany. Budou vymezeny pojmy vztahující se k dané oblasti a proveden určitý exkurs do historie právní úpravy úvěrů a spotřebitelských úvěrů u nás. Bude zdůrazněna platná právní úprava včetně její aplikace v praxi. Zmíněny budou základní druhy úvěrů, jejich náležitosti, veřejnoprávní úprava ochrany. Současně budou uvedeny podmínky a náležitosti rozhodčích řízení. Dále se práce zabývá i exekučním a insolvenčním řízením, které s ochranou spotřebitele ve finančnictví úzce souvisí. Názory budou konfrontovány s názory soudů různých stupňů k této problematice
