The issues of digital content as intellectual property

This bachelor’s thesis is about digital content and its sharing and distribution on the internet, Digital content brings with it the new issues stemming from its ease of distribution. The current intellectual property legislature attempts to address these issues, but these attempts are not completely effective.The objective of this thesis is to describe the shortcomings of legislature and the alternative non legislative methods of dealing with digital content and its issues.This thesis points out the imbalances between the rights of authors and consumers, the insufficient coverage of digital content in legislature, the causes of copyright infringement, also known as piracy and its negative impact on the economy, and also the inadequate protective solutions that have been deployed to battle it.In closure, a few solutions to these issues are proposed in attempt to achieve balance between both parties, impose greater limitations to the powers of corporations, implement a less intensive and more effective pushback strategy against piracy, improve the current payment system for authors and deploy marketing campaigns with better focus on public opinion.Tato bakalářská práce pojednává o digitálním obsahu a jeho sdílení a distribuci prostřednictvím internetu. Digitální obsah s sebou přináší nové problémy, které vychází z jeho snadné šiřitelnosti. Na tyto problémy se pokouší reagovat dosavadní legislativa pro úpravu duševního vlastnictví, nicméně ne zcela účinnými způsoby.Cílem práce je popsat problémy a nedostatky legislativy a také alternativní nelegislativní metody řešení problémů s digitálním obsahem.Práce poukazuje na nesoulad a nerovnost v právech autorů a spotřebitelů v legislativě, na nedostatečné pokrytí digitálního obsahu a jeho vlastností v zákonech, na porušování autorských práv neboli pirátství a jeho negativní vliv na ekonomiku a na selhání ochranných opatření, která mu měla zabránit.V závěru práce jsou navržena řešení těchto problémů, která se zaměřují na dosažení rovnováhy mezi právy obou stran, na omezení moci velkých korporací, navržení alternativního méně striktního přístupu v boji proti pirátství, vylepšení systému rozdělování poplatků či zvýšení povědomí veřejnosti pomocí cílených marketingových kampaní
