Segurado Facultativo. Múnus da Cobertura e do Atendimento Universal no Regime Geral de Previdência Social

The general objective of this paper is to study the optionally insured, from the analysis of the benefits and services that the General Social Security System (RGPS) can provide, thus demonstrating the possibility and advantages of entering this category in this system. Regarding the specific objectives, this paper aims to study the origin and history of Social Security; to point out the principles of Social Security; to conceptualize the mandatory and optionally insured of the General Social Security System; to indicate the costing obligations inherent to the optionally insured: calculation basis, rates and collection periods; to relate the benefits inherent to the optionally insured: benefits and services; and to conclude whether the incorporation of the optionally insured have, in fact, universalized Social Security in Brazil. The method adopted by this paper is the deductive, since the problems were analyzed through doctrinal works and the current legislation. Furthermore, regarding the applied procedure, it is of the bibliographic and documentary type. One of the main characteristics of social security is the need for direct contribution by its beneficiaries. In view of this, the social security regime should be based on a system of contributions and benefit concessions that allow its financial and actuarial survival. The optionally insured, due to the guidelines found in the Laws 8.212/91 and 8.213/91, in the Decree 3.048/99 and in the Normative Instruction no. 77/2015, contribute differently from the other insured. Considered as a positive and salutary measure of a Social State, the constitutional legislator did well by providing mandatory affiliation of the workers to the RGPS. It is worth mentioning that the Principle of Universality of Coverage and Care is an exception for the optionally insured, object of this study, because they will only be affiliated if they so desire and collect the respective contributions, since they do not perform paid work.O objetivo geral do presente trabalho é estudar o segurado facultativo, a partir da análise dos benefícios e serviços que o Regime Geral de Previdência Social (RGPS) pode propiciar, demonstrando assim, a possibilidade e as vantagens do ingresso desta categoria no referido sistema. No que tange aos objetivos específicos, este estudo propõe-se a estudar a origem e a história da Seguridade Social; apontar os princípios da Seguridade Social; conceituar os segurados obrigatórios e facultativos do Regime Geral de Previdência Social; indicar as obrigações de custeio inerentes ao segurado facultativo: base de cálculo, alíquotas e prazos de recolhimento; relacionar as prestações inerentes ao segurado facultativo: benefícios e serviços; e concluir se a incorporação do segurado facultativo, de fato, universalizou a Seguridade Social no Brasil. O método adotado neste trabalho é o dedutivo, uma vez que foram analisados os problemas por meio de obras doutrinárias e legislação vigente. Ainda, no que diz respeito ao procedimento aplicado, o mesmo é do tipo bibliográfico e documental. Uma das características principais da Previdência Social é a necessidade de contribuição direta pelos seus beneficiários. Em face disso, o regime previdenciário deve ser pautado em um sistema de contribuições e concessões de benefícios que permitam sua sobrevivência financeira e atuarial. Os segurados facultativos, em virtude das diretrizes encontradas nas Leis 8.212/91 e 8.213/91, pelo Decreto 3.048/99 e a Instrução Normativa nº 77/2015, contribuem de maneira diferenciada dos demais segurados. Considerada como medida positiva e salutar de um Estado Social, fez bem o legislador constitucional ao prever a obrigatoriedade de filiação ao RGPS dos trabalhadores em geral. Cabe destacar que o Princípio da Universalidade da Cobertura e do Atendimento é aqui excepcionado para os segurados facultativos, objeto desse estudo, pois apenas se filiarão se manifestarem a sua vontade e recolherem as contribuições respectivas, haja vista que não exercem atividade laboral remunerada
