ANALISIS SOSIO YURIDIS BENTUK-BENTUK TINDAK PIDANA YANG DILAKUKAN OLEH PARA PENGONSUMSI MINUMAN BERALKOHOL (STUDI KASUS DI KECAMATAN MAYANGAN KOTA PROBOLINGGO)

A liquor is identical with a criminal act, beside the person that consume this drinking is difficult to be stopped since the effect of this liquor which can make someone addicted therefore it makes the emotion becomes unstable when that person is intoxicated and it can damage the body for a long term consumption. The purpose of this study is to know and analyze the factors’ background of the drunkard and the criminal act that has been done by them. The method of this study is a Juridical Socio Approach. The writer chose the location of the research in Mayangan district, Probolinggo city by consideration that there are many of these phenomenon happened in that area. In collecting the data, the writer used interview method, observation, and documents. In explaining the result of the study, the writer used descriptive qualitative method. The result of this study are, the factor that caused someone consume the liquor is the society who permissive and apathies, the natural condition as a windy city, the society habit on Saturday night, the liquor is easy to get, less faith in their religion, and feeling reluctant with others. The form of criminal act that is caused by the person who consume the liquor which are: Disrupt the public law and order (Infraction of section 492 verse 1 Criminal Code), Interfere with the traffic (Infraction of section 492 verse 1 Criminal Code), Drunk on a street (Infraction of section 536 verse 1 Criminal Code), Goods Destroying (threated by section 406 Criminal Code), Abuse (threated by section 351 verse 1 Criminal Code). All of those things are the criminal act because they comply with the substances of that section. Those criminal acts are done because of the liquor consumption. Because drunk can influence someone consciousness and uncontrolled emotion thus he or she does the criminal act
