Protection of cultivated land: rural planning law and agricultural property and real estate law

This report is written on the basis of the questionnaire defined by the CEDR for 2nd Commission of the XXX European Congress of Agricultural law, held in Poznan in September 2019, 18-21. The questionnaire is organized in several points of attention, concerning the importance of planning instruments to protect agricultural land resources in each Country; the legal instruments aimed at counteract the degradation and devastation of agricultural land; the regulation on property transactions; the presence of legislative restrictions to the acquisition of agricultural property by foreigners; finally, the existence of “land grabbing” phenomenon in the Country and the related legislative measures aimed at limiting it. The report take into consideration all these topics, with the aim to draw an overview of the Italian legislative framework on the protection of cultivated land, by outlining the most representative legal tools laid down at national level
