Medida cautelar de suspensión provisional de los servidores y servidoras de la Función Judicial

The present investigation, focuses on the analysis of due process in the precautionary measure of the suspension of the servants and servants of the judicial function, said right being understood as a guarantee for other rights and principles, whose purpose is the protection of these against the actions of the state and constitutes, thus, that this investigation analyzes the procedure in the resolutions in which said precautionary measure has been adopted in processes substantiated in the provincial direction of the Judicial Council of Azuay, hence the problem of how inside its insufficient motivation, to establish if there is a violation of the right to due process in the guarantee of motivation. It is concluded that in the resolutions in which the precautionary measure for the overcoming of civil servants and judicial officers is adopted, there is a poor motivation, that is, they do not meet the parameters of reasonableness, logic and understandability.cautelar de la suspensión de las servidoras y servidores de la función judicial, entendiéndose dicho derecho como una garantía para otros derechos y principios, cuyo fin es la protección de éstos frente a las acciones del estado y constituye, es así, que esta investigación analiza el procedimiento en las resoluciones en las cuales se ha adoptado dicha medida cautelar en procesos sustanciados en la dirección provincial del Consejo de la Judicatura de Azuay, de ahí surge la problemática de cómo inside su insuficiente motivación, para establecer si existe vulneración al derecho al debido proceso en la garantía de la motivación. Se concluye que en las resoluciones en donde se adopta la medida cautelar de supensión de las funcionarias y funcionarios judiciales, existe una motivación deficiente, es decir no cumplan los parámetros de razonabilidad, lógica y comprensibilidad
