Relações entre direito e tecnologia no século XXI

In the area of Science, Technology and Society, and Law, the general objective of the text is to foster a new indicator of power, based on technological material developed with the increase of Artificial Intelligence (AI). This paper provides a discussion about Law and technology and the need for emancipatory functions in the management of the Artificial Intelligence (AI), at the risk of becoming an update of totalitarianism. Through a hypothetico-deductive method,conjunctures are discussed and through a bibliographical research, it is possible to conclude that the distancing of humanistic aspects can lead to the management of technology for deleterious purposes.Situado no campo da Ciência, Tecnologia e Sociedade e do Direito, o objetivo geral do texto é aventar um novo índice de poder, na base material tecnológica desenvolvida com o incremento da Inteligência Artificial (IA). O texto propicia a discussão sobre Direito e tecnologia enquanto imbricados e a necessidade de funções emancipatórias no manejo da Inteligência Artificial (IA), sob pena de tornar-se em atualização do totalitarismo. Pelo método hipotético dedutivo são trabalhadas conjunturas e pelo levantamento bibliográfico é possível concluir que o distanciamento dos aspectos humanistas pode levar ao manejo da tecnologia com fins deletérios
