Is it justified that courts review if political decisions adopted in law adjusts to the principles and rights recognized in the Constitution? In this article the question is answered by defending a post-positivism conception of Law, based on which it is admissible that the judicial authorities ─particularly constitutional courts, such as the Mexican Electoral Court of the Federal Judiciary─ solve the legal matters that are raised considering the principles and values that are recognized in the constitutional order of the State. Thus, it is justified the relevance for a constitutional democracy of the existence of a court that controls ─in a rational way─ the legal validity of law.
