PERTIMBANGAN HAKIM DALAM PUTUSAN HAK ASUH ANAK (HADHANAH) KEPADA SUAMI DI PENGADILAN AGAMA KAB. MALANG NOMOR 1285/Pdt.G/2019/PA. KAB. MLG

The author wishes to know the judge's considerations that make child custody holders (hadhanah) to her husband based on child protection law number 23 of 2003, Compilation of Islamic Law Article 105 letter a in several laws that it is the mother who is more entitled to babysit. a mother takes care of the child before the age of baliq or age 12 years, the panel of judges who try, examine the hadhanah claim, the decision of the Malang district religious court gives Hadhanah to the husband for the sake of the child based on the case ruling 1285 / Pdt.G / 2019 / PA.Kab Mlg. A research result shows that the judgment of the judges' most fundamental consideration is to think about the best interests of the child. Through the efforts of the judges to examine witnesses who know the social life of the child custody holder. Islamic law puts forward those who will make child custody holders are those who are responsible for carrying out as a present. Even though mothers have more rights in childcare, they are not yet mumayyiz, if they cannot take responsibility, custody can be given to their husbands for their children's interests.Keywords: Judges' Considerations, Hadhanah, VerdictPenulis berkeinginan untuk mengetahui pertimbangan hakim yang menjadikan pemegang hak asuh anak (hadhanah) kepada suami berdasarkan undang-undang perlindungan anak nomor 23 tahun 2003, Kompilasi Hukum Islam Pasal 105 huruf a dalam beberapa undang-undang bahwasanya ibu lah yang kebih berhak mengasuh anak. seorang ibu menjaga anak sebelum usia baliq atau umur 12 tahun, majelis hakim yang mengadili, memeriksa terhadap gugatah hadhanah, putusan majelis pengadilan agama kabupaten malang memberikan Hadhanah kepada suami demi kepentingan anak berdasarkan amar putusan perkara 1285/Pdt.G/2019/PA.Kab.Mlg. sebuah Hasil penelitian menunjukkan bahwa putusan pertimbangan majelis hakim paling fundamental adalah memikirkan kepentingan terbaik bagi anak. Melalui upaya-upaya majelis hakim memeriksa saksi-saksi yang mengetahui kehidupan sosial pemegang hak asuh anak. Hukum islam mengedepankan orang-orang yang akan menjadikan pemegang hak asuh anak adalah orang yang bertanggung jawab untuk melaksanakan sebagai hadin. Meskipun ibu lebih berhak dalam pengasuhan anak belum mumayyiz, apabila tidak bisa bertanggung jawab maka hak asuh dapat diberikan kepada suami untuk kepentingan anak.Kata kunci: Pertimbangan Hakim, Hadhanah, Putusa
