In Australia, the strict categorisation of UN Convention recognised refugees and asylum seekers by the Australian Government as ?offshore? and ?onshore? humanitarian applicants results in vast differences in entitlements for those seeking asylum (Correa-Velez et al 2005; Marston 2003a). The Temporary Protection Visa (TPV) was introduced in Australia in 1999 as an alternative to offering permanent protection for those deemed ?unauthorised arrivals? but who still meet the criteria for refugee status (Correa-Velez et al 2005; RCOA 2001). The TPV is granted upon release from detention and is valid for three years, after which time the applicant is required to apply again for refugee status and permanent protection (DIMIA 2005)
