EFEKTIVITAS PELAYANAN TERPADU SATU PINTU DALAM DALAM RANGKA MENINGKATKAN INVESTASI

ABSTRACTIn the relationship between the government and its citizens, licensing is often an indicator to assess whether a government organization has achieved good governance or not. Based on this condition, the government made a policy regarding the licensing model through the Minister of Home Affairs Regulation No. 24 of 2006 on guidelines for the implementation of one-stop integrated service. The purpose of this policy is to improve the quality of public services and to provide wider access to the public to obtain public services. Bureaucratic licensing is a complicated one of the problems that hamper the development of the economy. Communities and business actors often complain about the process of licensing services that require a long time, the number of agencies issuing permits and the amount of levies to be paid. Regulation of the Governor of West Kalimantan No. 13 year 2017 concerning the delegation of the authority of the signing of licensing and non-licensing issuance to the Head of West Kalimantan Provincial One Stop Service and Investment Service office (DPMPTSP) has given the DPMPTSP trust to handle the issuance licensing and recommendations. In accordance with the regulation of the Governor, the field of business handled DPMPTSP only reached 17 areas of government affairs. This study aims to find out how the implementation of the authority of DPMPTSP so far in an effort to increase investment, what factors inhibit not optimal effectiveness and how to improve the effectiveness of DPMPTSP authority in order to increase investment. The research method used is socio legal research to find theories about the process of happening and about the process of working the law in society. The result of this research shows that the implementation of the authority of DPMPTSP in an effort to increase the value of investment is in accordance with the laws and regulations related to investment and one-stop integrated services: Permendagri No. 138 of 2017 which replaces the Regulation of the Minister of Agriculture No. 24 of 2006. Increased investment value of both PMA and PMDN in West Kalimantan in accordance with the targets set by the National and RPJMD of West Kalimantan province. Investment shows a positive trend in accordance with delegated deliberations. The problems faced more focused on the organization or process of licensing products that affect the effectiveness of the service, which is not fully delegated authority of the signing delegated by the governor to the head of DPMPTSP because there is a central policy requiring the head of relevant agencies to sign the local regulation on retribution related to the authority of the institution, of OPD in PTSP, internal factors both the number of employees placed in the field of service is still lacking, facilities and infrastructure services are still lacking.ABSTRAKDalam hubungan antara pemerintah dan warganya, perizinan seringkali merupakan indikator untuk menilai apakah organisasi pemerintah telah mencapai tata pemerintahan yang baik atau tidak. Tujuan dari kebijakan ini adalah untuk meningkatkan kualitas layanan publik dan untuk menyediakan akses yang lebih luas kepada publik untuk mendapatkan layanan publik.Perizinan birokrasi adalah salah satu masalah rumit yang menghambat perkembangan ekonomi. Masyarakat dan pelaku bisnis sering mengeluh tentang proses layanan perizinan yang membutuhkan waktu lama, jumlah instansi yang mengeluarkan izin dan jumlah pungutan yang harus dibayarkan. Peraturan Gubernur Kalimantan Barat No. 13 tahun 2017 tentang pelimpahan wewenang penandatanganan penerbitan izin dan non-lisensi kepada Kepala Kantor Pelayanan Terpadu Satu Pintu dan Jasa Penanaman Modal (DPMPTSP) Provinsi Kalimantan Barat telah memberikan kepercayaan DPMPTSP untuk menangani pemberian lisensi dan rekomendasi penerbitan. Sesuai dengan peraturan Gubernur, bidang usaha yang ditangani DPMPTSP hanya mencapai 17 bidang urusan pemerintahan. Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan kewenangan DPMPTSP selama ini dalam upaya meningkatkan investasi, faktor-faktor apa yang menghambat efektivitas tidak optimal dan bagaimana meningkatkan efektivitas otoritas DPMPTSP dalam rangka meningkatkan investasi. Metode penelitian yang digunakan adalah penelitian sosio hukum untuk menemukan teori tentang proses terjadinya dan tentang proses kerja hukum di masyarakat. Hasil dari penelitian ini menunjukkan bahwa pelaksanaan kewenangan DPMPTSP dalam upaya meningkatkan nilai investasi sesuai dengan hukum dan peraturan yang terkait dengan investasi dan layanan terpadu satu pintu: Permendagri No. 138 tahun 2017 yang menggantikan Peraturan Menteri Pertanian Nomor 24 Tahun 2006. Meningkatnya nilai investasi baik PMA maupun PMDN di Kalimantan Barat sesuai dengan target yang ditetapkan oleh Nasional dan RPJMD Provinsi Kalimantan Barat. Investasi menunjukkan tren positif sesuai dengan pertimbangan yang didelegasikan.
