Dari Hasil Penelitian Menggunakan Metode Penelitian Hukum Normatif diperoleh kesimpulan Dalam Penelitian ini dapat diambil kesimpulan bahwa pengangkatan pimpinan perusahaan daerah (PDAM) kabupaten mempawah tidak sesuai dengan peraturan perundang-undangan dengan terbitnya SK Bupati tersebut. Surat Keputusan Bupati itu bertentangan dengan amanah perundang-undangan yang mengatur tentang pengelolaan perusahaan daerah, Seharusnya dalam hal pembentukan, penggabungan dan perubahan perusahaan daerah harus memiliki landasan hukum. “Pasal 177 UU No 32 Tahun 2004 telah jelas mengatur bahwa semua proses pembentukan BUMD atau perusahaan daerah harus melalui Perda, karena PDAM Mempawah telah dibentuk oleh Pemerintah Daerah TK II Pontianak melalui Perda No 11 Tahun 1977 dan ini sesuai dengan amanah UU No 5 Tahun 1962 tentang Perusahaan Daerah. “Artinya PDAM yang ada diberi Nama PDAM Tirta Dharma bukan PDAM Tirta Galaherang. Dan Artinya Hasil analisa dalam penelitian ini dengan terbitnya SK No 191 ini permasalahan ini terus dipersoalkan publik.PDAM Kabupaten Mempawah dikelola dengan prinsip-prinsip tata kelola Perusahaan yang baik (good corporate govermance), yakni professional, efisien, transparan, mandiri, akuntabel, patut/wajar, dan tertib administrasi, dalam penelitian ini bahwa pengangkatan Pimpinan perusahaan Daerah (PDAM) Kabupaten mempawah tidaklah berjalan baik karena terus dituai kritik oleh para pakar atau aktivis politikus partai dalam ruang lingkup DPRD kabupaten mempawah, Pada dasarnya tidak ada produk hukum tentang pengelolaan perusahaan daerah yang disusun atau disahkan selama tahun 2010, terlihat bahwa aparatur pemerintah tidak tertib dalam pengadministrasian tata kelola pemerintahan permasalahan SK Direktur PDAM. adalah tentang temuan kesalahan penyusunan SK Artinya aparatur pemerintah tidak tertib dalam pengadministrasian tata kelola pemerintahan. SK Nomor 191 itu bertentangan dengan UU No 32 Tahun 2004 tentang Pemerintahan Daerah dan UU No 5 Tahun 1962 tentang perusahaan daerah, artinya, dasar hukum dalam SK pelantikan tersebut tidak sesuai dengan aturan yang berlaku artinya bahwa pelantikan itu batal demi hukum, sehingga patut disayangkan dalam proses pelaksanaan penerapan asas-asas good governance tidak dapat berjalan sebagaimana mestinya dalam hal ini Asas Kepastian Hukum, Asas Tertib Penyelenggaraan Negara, Asas Kepentingan Umum, Asas Keterbukaan, Asas Proporsionalitas, Asas Profesionalitas, tidak berjalan sesuai kehendak.Kata Kunci : Pengangkatan Pimpinan Perusahaan Daerah, Good Governanc
