The article has as aim examine the development of the legislation on the mental health in the context of the sanitary Italian model. The mental health, and especially the juridical condition of the people that they have some mental disorder, represent an observatory favoured to analyze and to emphasize, with the materials that the constitutionalist perspective offers, the contradictions that still persist in The Italian System, as well as the difficulties of rejecting or guaranteeing some forms of guardianship of certain rights, and their evolutionary lines, in the field of the civil and social laws, which have tried to return the social “dignity” to the so called “crazy persons”.
