ADPF 347/DF

This dissertation deals with the discussion about the Unconstitutional State of Affairs before the Federal Supreme Court, especially in ADPF 347/DF. Initially we will deal with its historical origin, concepts and requirements until the analysis of ADPF 347/DF, including its appropriateness, assumptions, requests and amplitude of the decision. Finally, we will analyze aspects related to the said institutional rise of the Judiciary relating to the ECI. We use as a research methodology the bibliographical, jurisprudential and legislative revision pertinent to the matter, specially making use of publications of the World Computer Network, given the novelty of the discussions about the subject in Brazil. ADPF requesting the declaration of the ECI dates from 2015. The authors dispute the applicability of the ECI to the Brazilian prison system on multiple grounds. We do not find the constitutional permissive for an extension of powers to the Judiciary, even in the face of the seriousness of the situation faced by prison system. It seems to us a contradiction to enforce the Constitution through its non-compliance.A presente dissertação trata da discussão acerca do Estado de Coisas Inconstitucional perante o Supremo Tribunal Federal, em especial na ADPF 347/DF. Inicialmente trataremos de sua origem histórica, conceitos e requisitos até a análise da ADPF 347/DF, incluindo seu cabimento, pressupostos, pedidos e amplitude da decisão. Por fim, analisaremos aspectos referentes à dita ascensão institucional do Judiciário relacionando ao ECI. Utilizamos como metodologia de pesquisa a revisão bibliográfica, jurisprudencial e legislativa pertinente à matéria, fazendo uso especialmente de publicações da Rede Mundial de Computadores, diante da novidade das discussões acerca do tema no País, uma vez que a ADPF pleiteando a declaração do ECI data de 2015. Os autores controvertem quanto à aplicabilidade do ECI ao sistema carcerário brasileiro sob múltiplos fundamentos. Não encontramos permissivo constitucional para uma ampliação de poderes ao Judiciário, mesmo diante da gravidade da situação enfrentada pelo referido sistema. Parece-nos um contrassenso fazer cumprir a Constituição através do seu descumprimento
