A proteção da criança refugiada, em especial através do reagrupamento familiar

The intensification of the migration flows of children to the European Union since 2015 requires a more positive response from the Member States to adequately address the particular needs of these children, who were forced to leave their countries of origin with or without the company of a parent or other family member who has the child custody. Most of the children arriving in the EU are children who seek to escape situations of conflict that are widespread in their countries of origin and had previously experienced traumatic situations and abuse of their rights. In the light of EU law, most of these children are protected by the status of subsidiary protection, because they have not been individually persecuted and therefore, do not enjoy the refugee status. Many others qualify for the refugee status. The present dissertation deals with the inherent rights that come from international protection status, particularly the right to family reunification, when this is done in the best interests of the child. Member States are required to adopt a policy of non-discrimination on the basis of legal status, and there is therefore a need for greater protection of the right to family reunification compared with the protection that is currently provided to children that enjoy subsidiary protection status, as well as a flexible interpretation of the concept of family, beyond the nuclear family. The best interests of the child have to be taken into account in any decision concerning the child, whether it concerns family reunification or cases involving the expulsion of a child or of a family member from the host country.A intensificação do fluxo migratório de crianças carecidas de proteção internacional a chegar à União Europeia desde 2015 exige por parte dos Estados-membros, uma resposta adequada às necessidades particulares destas crianças que por variados motivos, são forçadas a abandonar os seus países de origem com ou sem a companhia dos progenitores ou outro familiar que tenha a guarda da criança. A maioria das crianças provenientes dos conflitos no Médio Oriente que chegam à UE são crianças que procuram escapar a situações de conflito generalizado nos seus países de origem e que já passaram por situações traumáticas e abusos dos seus direitos. À luz do direito da UE, a proteção da maior parte destas crianças consubstancia-se no estatuto de proteção subsidiária, ou seja, não são refugiadas uma vez que não são vítimas de perseguição, mas correm ainda assim, o risco de vida, de tortura ou tratamento desumano e degradante caso retornem ao país de origem. Ainda, muitas são aquelas que se qualificam para o estatuto de refugiadas. A presente dissertação versa sobre os direitos inerentes ao estatuto de proteção internacional, particularmente, o direito ao reagrupamento familiar sempre que este direito estiver em conformidade com o superior interesse da criança. Exige-se por parte dos Estados-Membros, uma política de não discriminação com base no estatuto jurídico, pelo que deverá existir ao nível comunitário e nacional, uma maior proteção do direito ao reagrupamento familiar das crianças beneficiárias de proteção subsidiária comparativamente à proteção que existe atualmente, e uma interpretação flexível do conceito de família, que abranja outros membros da família para além da família nuclear. O superior interesse da criança deverá ser tomado primacialmente em consideração, quer nos casos relativos ao reagrupamento familiar, quer nos casos relativos à expulsão de uma criança ou de um familiar do país de acolhimento
