Independent Regulatory Agencies and Policy Change : A Case Study of the Canadian Radio-Television and Telecommunications Commission

Unabhängige Regulierungsbehörden, die außerhalb der klassischen Exekutivhierarchie stehen und auf gesetzlicher Basis eigene Kompetenzen und Zuständigkeiten in der Regulierung von Märkten haben, finden sich mittlerweile in vielen Ländern der westlichen Welt. Dieser Organisationsform werden spezifische Leistungsvorteile zugeschrieben, insbesondere fachliche Expertise, Effizienz und Flexibilität sowie größere Partizipationsmöglichkeiten für die interessierte Öffentlichkeit. Gleichzeitig stehen unabhängige Regulierungsbehörden aufgrund ihrer breiteren eigenen Gestaltungskompetenzen in parlamentarischen Demokratien in einem starken Spannungsverhältnis zu traditionellen repräsentativ-demokratischen Legitimationsvorstellungen. Die vorliegende Studie untersucht am Beispiel der Canadian Radio-Television and Telecommunications Commission (CRTC), der kanadischen Aufsichtsbehörde für Rundfunk und Telekommunikation, die Bedingungen und Grenzen einer politisch-gestaltenden Rolle von unabhängigen Regulierungsbehörden in einer Situation, in der traditionelle Policy-Konzepte aufgrund des technologischen Fortschritts und des Vordringens neoliberaler Leitvorstellungen unter Veränderungsdruck geraten. Vor dem Hintergrund der spezifischen Leistungserwartungen an unabhängige Regulierungsbehörden wird gefragt, ob und wie die CRTC auf die Veränderungen in ihrer Umwelt reagiert, wie die Behörde die betroffenen Interessengruppen in ihre Entscheidungsfindung einbindet und wie sich im Wandel der regulativen Politiken die Arbeitsteilung und Kontrolle in der Beziehung zwischen den verantwortlichen Ministerien und der Behörde gestalten. Damit versteht sich die Studie als Beitrag zur aktuellen Diskussion über das "Gesicht des regulativen Staates".Independent regulatory agencies which are organizationally separate from governments and, through public law, endowed with their own powers and responsibilities in the regulation of markets have proliferated throughout the Western world. This type of organization is said to have specific functional advantages, in particular expertise, efficiency and flexibility as well as greater opportunities for public participation. Yet, due to their often considerable discretion, independent regulatory agencies pose a challenge to traditional notions of legitimation in parliamentary democracies. Focusing on the Canadian Radio-Television and Telecommunications Commission (CRTC), the agency responsible for regulating broadcasting and telecommunications in Canada, this study examines the conditions and limits of policy-making by an independent regulatory agency in a situation in which traditional policy concepts are undermined by technological change and the diffusion of neoliberal ideologies. Against the backdrop of the functional advantages attributed to independent regulatory agencies, the analysis explores whether and how the CRTC reacts to changes in its environment, how the agency integrates concerned interest groups into its decision-making process and how the relationship between the responsible departments and the agency evolves in terms of control and the allocation of tasks in the process of policy change. Thus, the study seeks to contribute to the current debate on the "face of the regulatory state"
