PEWARISAN PADA MASYARAKAT Di Kecamatan Sanggala ana Toradja The Custom of Inheritance in The Traditional Community in Subdistrict Sanggalla Tana Toradja

This research on the custom of inheritance in the traditional community in Subdistrict Sangalla Tana Toraja is a descriptive and analytical research which seeks to bring to light various issues dealt within the scope of this research.This research aims to identify problems, changes or developments related to the practise of the custom of inheritance, as well as the factors which affect the changes or developments in the local traditional community.The research findings indicate that the customary law concerning inheritance has undergone changes in which some elements have been abandoned and some new elements have been incorporated into the customary law. In the past, when community members were adherents of the aluk to dolo faith, it was possible to divide the inheritance either before a legator\u27s death, which was called ba\u27gi, or after a legator\u27s death, which was called mantunu and carried out during the performance of a ritual ceremony called rambu solo\u27. Under this system, there was a possibility for the property obtained through ba\u27gi to be increased or reduced corresponding so the number of sacrifices - buffaloes or pigs - given away during mantunu. This happened because according to the aluk to dolo faith, the animal sacrificed during mantunu served as the dead person\u27s provision and vehicle on his journey to puya.Nowadays, the division of inheritance among the local community is no longer strictly based on the number of sacrificed animals given away during mantunu. Everything is based on family consensus so that there is a balanced share for each legatee. The mantunu ritual is still performed symbolically to conform to the local customs, and not as a means of fighting for the property bequeathed by the parents.The factors that contribute to these changes are religious conversion and educational standard which affect the local community\u27s ways of thinking. Division of inheritance, therefore, is no longer based on the number of sacrificed animals, but on love among family members as tought by religion.In anticipation of the establishment of a national law concerning inheritance, it is hoped that there will be more holistic researchers on the customary law concerning inheritance so that in the future the national law will reflect the sense of justice which is acceptable to the traditional communities.
