Pertimbangan-Pertimbangan Hakim Dalam Menyelesaikan Perkara-perkara Yang Diajukan oleh Orang-orang Yang Tidak Beragama Islam Pada Pengadilan Agama Di DIY

Religion Court has a duty and an authority to investigate, decide, and settle cases in first level among Moslems in : a. marriageb. inheritance, wasiah, and hibah that can be executed according to Islamic Lawc. wakaf and shadaqah (Article_49 (1) Act 7 of 1989). Religion Court also settles cases that can be remanded by non-moslems. This research examines consideration and legal consideration of Religion Court judge in settleng cases remanded by non-moslems. Research data were taken by studying 30 case documents from 3 samples of Religion Court in Yogyakarta Special Province. Besides that, this research was completed by conducting interview with 3 informants from Religion Court. After collecting data, it was analyzed by descriptive-qualitative method. The research shows that judge consideration in settleng cases remanded by nonmoslems is guided on case, not on a person who remands a case, based on Article 49 Act 7 of 1989
