PERLINDUNGAN HUKUM TERHADAP PEKERJA ANAK YANG BEKERJA DISEKTOR PERKEBUNAN KELAPA SAWIT DITINJAU DARI UU 13 TAHUN 2003 TENTANG KETENAGAKERJAAN JO UU 23 TAHUN 2002 TENTANG PERLINDUNGAN ANAK (STUDI DI KABUPATEN KUBU RAYA)

ABSTRACTThis thesis focuses on the legal protection of child laborers working in the oil palmsector in terms of Act No. 13 of 2003 on Labor jo Law No. 23 of 2002 on theProtection of Anak.Dari study authors using sociological obtained legal researchconclusions: 1) .bahwa conditions of children working in the palm oil sector if it isassociated with article 69 paragraph 2 of Law No. 13 Year 2003 jo Law No. 23 of2002 on Child Protection, everything is not met. Highway district government camp must make abreakthrough in the form of policies that can attract children who work to return toschool.ABSTRAKTesis ini menitikberatkan pada perlindungan hukum terhadap pekerja anak yangbekerja di sektor perkebunan kelapa sawit ditinjau dari UU No 13 Tahun 2003Tentang Ketenagakerjaan jo UU No 23 Tahun 2002 Tentang PerlindunganAnak.Dari penelitian penulis dengan menggunakan metode penelitian hukumsosiologis di peroleh kesimpulan : 1).bahwa kondisi anak-anak yang bekerja disektor perkebunan kelapa sawit jika dikaitkan dengan pasal 69 ayat 2 UndangUndang Nomor 13 Tahun 2003 jo Undang Undang Nomor 23 Tahun 2002 tentangPerlindungan Anak, semuanya tidak terpenuhi. Artinya ada penyimpanganpenyimpanganyang dilakukan pihak perusahaan dalam mempekerjakan anak dalamkonteks hukum. Kondisi ini tentu harus mendapat perlindungan dari pemerintahdaerah Kabupaten Kubu Raya, seharusnya anak-anak tersebut tidak diperkenankanuntuk bekerja, karena usia anak tersebut masih dalam usia yang seharusnya dudukdibangku sekolah. Pemerintah daerah tampaknya kurang memperhatikan secaraserius terhadap pekerja anak ini. Hal ini, dapat dilihat dari tidak adanya tindakannyata dari pemerintah daerah, baik dalam bentuk penghentian operasionalperusahaan ataupun pencabutan izin usaha perkebunan dan lebih jauh lagi tidakusaha dari pemerintah daerah Kabupaten Kubu Raya untuk menarik anak-anaktersebut dari perusahaan-perusahaan perkebunan dimana anak tersebut bekerja.2).Bahwa faktor yang menyebabkan anak bekerja di perkebunan kelapa sawit adalahFaktor Kemiskinan dan Ekonomi ; Faktor Sosial Budaya; Faktor PendidikanPengawasan.3). Bahwa langkah-langkah yang telah dilakukan oleh Dinas TenagaKerja dan Transmigrasi yakni Pemanggilan terhadap anak dan orang tua.Pemanggilan terhadap Pihak Perusahaan Perkebunan Kelapa Sawit. Dua langkahini menjadi sangat sia-sia, karena tindakan-tindakan refresif dari Dinas Tenaga Kerjadan Transmigrasi Kubu Raya sama sekali tidak ada. Dinas Tenaga Kerja danTransmigrasi Kubu Raya hanya memberikan pengarahan-pengarahan saja, yanglebih bersifat imbaun. Kondisi ini tentu tidak menjadi efek jera bagi perusahaan untuk3tetap mempekerjakan anak sebagai tenaga kerja. Saran-saran adalah 1). Harusdilakukan upaya hukum preventif berupa pengawasan ketenagakerjaan yangberkesinambungan dan upaya hukum refresif berupa tindakan-tindakan hukumnyata yang dapat memberikan efek jera bagi perusahan perkebunan kelapa sawityang mempekerjakan anak.2). Pemerintah daerah kabupaten kubu raya harusmembuat terobosan berupa kebijakan yang dapat menarik anak-anak yang bekerjauntuk kembali bersekolah
