PERAN NEGARA DALAM MEMBERIKAN PERLINDUNGAN TERHADAP ANAK DARI TINDAK PIDANA SESUAI KONVENSI PBB

ABSTRACTThat the role of the state in providing protection to children from the criminal act has been ratified in accordance with the UN Convention, including on children as perpetrators as well as victims of sexual abuse. Legal protection of children involved in sexual abuse, through the efforts of alternative "diversion and restorative justice" carried out by the police, prosecutor and judge in resolving the problem of children in conflict with the law of the case-light case. This diversion efforts can be done using diskretioner authority (discretionary) owned by the Police to judge actions performed by a child lightly.False perspective on criminal cases of rape committed by a child with a victim under the age of both children as victims and as perpetrators of child to get their rights in a fair and wise would be jurisfrudensi to another judge.In this regard, it is necessary to attempt to establish positive cooperation, both with the government and with NGOs as part of the efforts of law enforcement officers in conducting diversion and restorative justice. So that the diversion and restorative justice can be promoted and developed as a solution for settling disputes children in conflict with the law.Then it is necessary to increase knowledge about the Children's Police Investigators particularly negative access of the solution to the child by means of the Child Criminal Justice System (SPP). Police need to develop values that regard the use of discretionary authority as a positive step.Judge in making decisions on those cases children in conflict with the law are not only concerned with justice for children as perpetrators but also children as victims (especially not felonies committed by children and children as victims).Keywords : Protecting Children From CrimePage | 2A B S T R A KBahwa peranan negara dalam memberikan perlindungan terhadap anak dari tindak pidana sudah meratifikasi sesuai dengan konvensi PBB, termasuk didalamnya mengenai anak sebagai pelaku sekaligus sebagai korban pelecehan seksual. Perlindungan hukum terhadap anak yang terlibat dalam masalah pelecehan seksual, melalui upaya alternatif “diversi dan restorative justice” yang dilakukan oleh Polisi, Jaksa dan Hakim dalam menyelesaikan masalah anak yang berkonflik dengan hukum terhadap perkara-perkara ringan. Upaya diversi ini dapat dilakukan dengan menggunakan kewenangan diskretioner (diskresi) yang dimiliki Kepolisian terhadap perkara-perkara ringan yang dilakukan oleh anak.Cara pandang yang keliru terhadap perkara tindak pidana pemerkosaan yang dilakukan oleh anak dengan korban dibawah umur baik anak sebagai korban dan anak sebagai pelaku untuk mendapatkan hak-haknya secara adil dan bijaksana akan menjadi jurisfrudensi bagi hakim lain.Berkaitan dengan hal tersebut, maka diperlukan adanya upaya untuk menjalin kerjasama yang positif, baik dengan instansi pemerintah maupun dengan LSM sebagai bagian dari upaya aparat penegak hukum dalam melakukan diversi dan restorative justice. Sehingga diversi dan restorative justice dapat dipromosikan dan dikembangkan sebagai solusi penyelesaian perkara anak yang berkonflik dengan hukum.Kemudian diperlukan adanya peningkatan pengetahuan Polisi khususnya Penyidik Anak tentang akses negatif dari penyelesaian masalah anak melalui sarana Sistem Peradilan Pidana Anak (SPP). Kepolisian perlu mengembangkan nilai yang memandang penggunaan kewenangan diskresi sebagai langkah positif.Hakim dalam mengambil keputusan terhadap perkara-perkara anak yang berkonflik dengan hukum tidak hanya memperhatikan keadilan bagi anak sebagai pelaku tetapi juga anak sebagai korban (khususnya tidak pidana berat yang dilakukan oleh anak dan anak sebagai korban).Kata Kunci : Perlindungan Terhadap Anak Dari Tindak Pidan
