A EJA como direito na legislação e na política educacional brasileira: uma análise da década de 1930 ao contexto atual

This paper discusses, in terms of historical trajectory, the definition of the statute of Youth and Adult Education in the Brazilian educational legislation, from the first references to its recognition as the right of those who were excluded from the schooling process at the so-called proper age and its claim as a duty of the state. It highlights, in the current context, the existing gap between the proclamations of the legal provisions and official documents and the actual reality of offering this type of education as a public policy. As a temporal delimitation for the analysis, the period from the Vargas Era to the current context was chosen, including redemocratization, the Military Dictatorship and the New Republic. The choice of the Vargas Era as a starting point is justified on the understanding that it is only from this period that one can speak of the definition of an educational policy at the national level. Regarding the methodology, it was adopted the documental analysis and the bibliographical revision as methodological instrument, from the study of legal documents and the available literature about the subject.O presente trabalho discute, em termos de trajetória histórica, a definição do estatuto da Educação de Jovens e Adultos na legislação educacional brasileira, desde as primeiras referências até o seu reconhecimento como direito daqueles que foram excluídos do processo de escolarização na chamada idade própria e da sua afirmação como dever do Estado. Destaca, no contexto atual, o hiato existente entre as proclamações dos dispositivos legais e documentos oficiais e a realidade efetiva da oferta desta modalidade de ensino como política pública. Como delimitação temporal para a análise, escolheu-se o período que vai da Era Vargas até o contexto atual, passando pela redemocratização, pela Ditadura Militar e pela Nova República. A escolha da Era Vargas como ponto de partida é justificada com base no entendimento de que é somente a partir deste período que se pode falar na definição de uma política educacional em âmbito nacional. No que concerne à metodologia, adotou-se a análise documental e a revisão bibliográfica como instrumental metodológico, a partir do estudo de documentos legais e da literatura disponível acerca do tema
