ANÁLISE DAS DECISÕES PROFERIDAS DO TJPB RELACIONADAS AO CÂNCER DE MAMA NO ANO 2018

The right to health has generated great discussions aimed at the full fulfillment of this right, being sought in the pertinent legal spheres. In this way, the judicial demands can serve as a sentinel to the main problems faced by health care systems, being of fundamental importance the study of these complaints. This study addresses the judicialization in breast cancer-related health whether through public or supplementary care. Through the analysis of lawsuits contained in the online public database of the Court of Justice of the State of Paraíba. With the application of the requirements established methodologically, we analyzed 9 actions related to lawsuits to provide health services to breast cancer patients. The period of search of the analyzed records was of the year of 2018. In addition to quantifying and describing the profile of the demands brought to justice, a qualitative analysis of judicial decisions was sought. . The study concluded that there were no studies with the present cutout that was analyzed, directed to breast cancer. He also identified that the main judicial problems are the search for drug supply and authorization of procedures. It concluded that the normative framework has been used harmonically in the case-law analyzed. It was also found nuances of possible changes in jurisprudence in the decisions to come due to decisions of repetitive appeals and of general repercussion published in the year 2018.O direito à saúde tem gerado grandes discussões direcionada ao cumprimento integral deste direito, sendo pleiteado nas esferas jurídicas pertinentes. Desta forma, as demandas judiciais podem servir como sentinela aos principais problemas enfrentados pelos sistemas assistenciais à saúde, sendo de fundamental importância o estudo destas reclamações. Este estudo aborda a judicialização na saúde relacionada ao câncer de mama seja através da assistência pública ou suplementar. Por meio da análise de ações judiciais contidas na base pública on-line do Tribunal de Justiça do Estado da Paraíba. Com a aplicação dos requisitos estabelecidos metodologicamente, foram analisadas 9 ações relacionadas a demandas judiciais a prestação de serviços de saúde a portadores do câncer de mama. O período de busca dos registros analisados foi do ano de 2018. Além de quantificar e descrever o perfil das demandas levadas à Justiça, buscou-se a análise qualitativa de decisões judiciais. . O estudo concluiu que não existiam trabalhos com o recorte presente que foi analisado, direcionado ao câncer de mama. Também identificou que os principais problemas judicializados são a busca for fornecimento de medicamentos e autorização de procedimentos. Concluiu que o arcabouço normativo tem sido utilizado harmonicamente na jurisprudência analisada. Foi encontrado também nuances de possíveis modificações nas jurisprudência nas decisões vindouras devido a decisões de recursos repetitivos e de repercussão geral publicados no ano de 2018
