A inserção da polícia militar no estado democrático de direito: há compatibilidade?

The present dissertation had as objective to evaluate if there is compatibility in the insertion of the military police in the democratic state of law. As applied methodologies for the discussion of the mentioned subject, we used the bibliographical research, the documentary and the field research, in which initially, a historical analysis of the emergence of the human rights in the Brazilian constitutions was done, with the intention of observing the evolution Rights under the country's legal system. With regard to the military police, a history has been made on the subject of public security since the emergence of the country as a Sovereign State, as well as the option for the militaristic model of the present day. In order to base the discussion on the presence of a military police post 1988, a study was made of the structural foundations of the Armed Forces and Military Police, comparing if the structures of these organizations and their institutional objectives are similar, in the light of the Major Law Of 1988, analyzing whether there are justifications for linking them. As a result of this analysis, we talked about the main models of police adopted in the world and the strategy of the Full Cycle of Police as a possible alternative to the public security system of Brazil. A comparison was made between the public security agents described in the Charter of 1988, where the distinction between civilian agents and military police was observed, observing differences of human rights for each category. As for the methodological procedures used in the field research, the data collection technique was applied, applying a structured script to the Military Police of Paraíba belonging to the PMPB Education Center, so that, in addition to the theoretical view of the theme, it was also Captured the impression of those who experience in their daily life the reality of the military institution, using as basis for the creation of the questions what had been described throughout the chapters of this dissertation. The results of the field research have noted that the military police investigated yearn for changes in their institution, from the structural point of view as well as the rights that they must have in the light of human rights. As a conclusion of the work, it was noticed that despite the changes that occurred with the 1988 Charter, there was no significant evolution in the field of Public Security. Both in the structural aspect, which has no coherence with the contemporary models of police used by several countries, but also for maintaining a military structure to take care of a civil activity such as Public Security. It was observed that the 1988 Democratic Constitution distinguishes two types of citizen, one military and one civilian, since at various times Brazilian law classifies the military police officer as a person different from the others and, consequently, suppresses rights that are guaranteed to All other citizens, both as an ordinary person and as public agent. Thus, there is no compatibility between the Military Police and the Democratic State of Law, so that this institution does not fit the parameters established in the Constitution of 1988, both in the structural point of view and in the classification of the military police as a citizen different from the too.A presente dissertação teve como objetivo avaliar se há compatibilidade na inserção da polícia militar no estado democrático de direito. Como metodologias aplicadas para a discussão do tema citado, utilizou-se a pesquisa bibliográfica, a documental e a pesquisa de campo, em que inicialmente, foi realizada uma análise histórica do surgimento dos direitos humanos nas constituições brasileiras, com o intuito de observar a evolução desses direitos dentro do ordenamento jurídico pátrio. No tocante a polícia militar, fez-se um histórico sobre a temática da segurança pública desde o surgimento do país como Estado Soberano, bem como a opção pelo modelo militarista dos dias atuais. Para embasar a discussão com relação à presença de uma polícia militar pós 1988, fez-se um estudo sobre os fundamentos estruturais das Forças Armadas e da Polícia Militar, comparando se as estruturas dessas organizações e seus objetivos institucionais são semelhantes, à luz da Lei Maior de 1988, analisando se há justificativas para vinculação entre elas. Em decorrência dessa análise, falou-se sobre os principais modelos de polícias adotados no mundo e a estratégia do Ciclo Completo de Polícia como possível alternativa para o sistema de segurança pública do Brasil. Fez-se ainda um comparativo entre os agentes de segurança pública descritos na Carta Magna de 1988, em que se constatou a distinção entre agentes civis e os policiais militares, observando diferenças de direitos humanos para cada categoria. Quanto aos procedimentos metodológicos utilizados na pesquisa de campo, utilizou-se a técnica de levantamento de dados, aplicando um roteiro estruturado junto aos Policiais Militares da Paraíba pertencentes ao Centro de Educação da PMPB, para que, além da visão teórica do tema, também fosse captada a impressão daqueles que vivenciam no seu cotidiano a realidade da instituição militar, utilizando como base para a criação das perguntas o que fora descrito ao longo dos capítulos desta dissertação. O resultado da pesquisa de campo observou que os policiais militares pesquisados anseiam por mudanças na sua instituição, tanto do ponto de vista estrutural quanto no tocante aos direitos que estes devem possuir à luz dos direitos humanos. Como conclusão do trabalho, percebeu-se que apesar das mudanças ocorridas com a Carta de 1988, não houve evolução significativa no campo da Segurança Pública. Tanto no aspecto estrutural, que não possui coerência com os modelos contemporâneos de polícia utilizados por vários países, como também por manter uma estrutura militar para cuidar de uma atividade de cunho civil como é a Segurança Pública. Observou-se que a Constituição Democrática de 1988 distingue dois tipos de cidadão, um militar e um civil, haja vista que em vários momentos as leis brasileiras classificam o policial militar como uma pessoa diferente das demais e, consequentemente, suprime direitos que são garantidos a todos os demais cidadãos, tanto no aspecto de pessoa comum, como no de agente público. Sendo assim, não há compatibilidade entre a Polícia Militar e o Estado Democrático de Direito, de forma que tal instituição não se adequa aos parâmetros estabelecidos na Constituição de 1988, tanto no ponto de vista estrutural quanto na classificação do policial militar como um cidadão diferente dos demais
