A prostituição feminina e associação de prostitutas da Paraíba: movimento social, luta política e reivindicação de direitos

This dissertation approaches feminine prostitution in the city of João Pessoa and its legal and social implications. The former are considered where legal regulation of the activity is concerned, and the latter where the associative movement and the founding of the Prostitute s Association of the State of Paraíba - Brazil (APROS-PB Associação de Prostitutas da Paraíba). The research stemmed from the author s involvement in a Research and Study Group on Gender and Law at UFPB (the NEPGED), participation in the Institutional Scientific Initiation Project with a scholarship (PIBIC) and working at the NGO Dignitatis, which provides assistance in Human Rights issues and was responsible for making the first contact with the APROS-PB possible. Thus, it was a socio-legal work, which included field and bibliographical research. In its practical aspect, the research focused on maintaining contact with the prostitutes daily life and their associative movement, collecting data by means of interviews. Data from legal processes which occurred in Paraíba s State Court of Law were also collected. The theoretical aspect, on the other hand, was covered by bibliographical research. On its structure, the work was divided into three chapters. The first included theoretical and legal aspects, dealing with subjects such as prostitute s rights and the legal regulation of their activity. The second chapter brings the methodology chosen and its implications and links with the researched group. The third chapter deals with the APROS-PB and its relation to feminine prostitution in the State of Paraíba. This research aimed at fighting prejudices that affect prostitutes, especially the ones which put them in the condition of mere victims, and advocates for them to be viewed as protagonists of their lives. In this sense, the adopted position was against the aforementioned denial and in favour of recognizing their activity with all the legal consequences required.Coordenação de Aperfeiçoamento de Pessoal de Nível SuperiorA presente dissertação aborda a questão da prostituição feminina de baixo meretrício na cidade de João Pessoa e seu respaldo jurídico, no que tange a regulamentação legal da atividade, e social, no que toca o movimento associativo e a formação da Associação de Prostitutas da Paraíba (APROS-PB). A pesquisa se desenvolveu a partir do envolvimento da autora com o Núcleo de Pesquisa e Estudos sobre Gênero e Direito (NEPGED), participação como bolsista de iniciação científica (PIBIC) e do trabalho junto à ONG Dignitatis - Assessoria Técnica Popular, que foi responsável por proporcionar o primeiro contato com a APROS-PB. Tratou-se, portanto, de uma pesquisa sociojurídica envolvendo trabalho de campo e pesquisa bibliográfica. Em seu aspecto prático, o trabalho buscou contato com o cotidiano das prostitutas e o movimento associativo, coletando dados por meio de entrevistas. Também foram coletados dados de processos judiciais que tramitaram do Tribunal de Justiça da Paraíba. O aspecto teórico, por sua vez, foi contemplado pela pesquisa bibliográfica. No que diz respeito à sua estrutura, optou-se por uma divisão em três capítulos. No primeiro, foi abordado o aspecto teórico e jurídico, considerando temas como a discussão acerca dos direitos das prostitutas e da regulamentação jurídica de sua atividade. O segundo capítulo traz a metodologia escolhida à tona e discorre sobre suas implicações e o grupo pesquisado. O terceiro e último capítulo trata da APROS-PB e como esta se relaciona com a prostituição feminina em sua área de atuação. O trabalho também foi voltado a combater preconceitos sobre a condição das prostitutas, sobretudo a sua vitimização, advogando por um ponto de vista onde sejam enxergadas como protagonistas de suas vidas. Nesse sentido, o posicionamento adotado foi contra a subalternização das prostitutas e a favor do reconhecimento de sua atividade com as devidas consequências jurídicas
