PROSTITUSI DITINJAU DARI PERSPEKTIF SOSIOLOGI HUKUM

In an effort to realize the enforcement of the rule of law in Indonesia, a law product is required, in this case the law that acts as regulator of all actions the community, as well as a forced tool to the community. With the advancement of the times, that what we can see is the result of development so the changes arise, from the changes of lifestyle and the appereance of social issues in a society. One from of perversion (community issues) that we can say social problem is adultery wich is very dangerous. Although the problem of prostitution can lead to moral and mental damage and can destroy the unity of the family, but in the positive law itself, does not prohibit the practice of prostitution. The problem formulation 1. How is the prostitution’s life viewed from the perspective of legal sociology? 2. How is government policy to overcoming this prostitution issues? This research method is using normative research type, that is by reviewing them, based on legal literature materials and this is a process to finding out the rule of law.The legal principles and the legal provisions and the problem approach that is used in this thesis is a secondary legal material, that is material obtained from library materials (library research).There is nothing in the Criminal Code (in this case KUHP) that specifically regulates prostitution. The articles 296 and article 506 of the Criminal Code (KUHP) are only intended for brothels owned by pimps. So there is a void of norms against the article or prostitution. And the prostitution problem is only regulated in local regulations, especially the city of Denpasar regulation article number 2, year of 2000.Thefore there must be a refinement of the Criminal Code (KUHP), so with that, the law enforcement officers, especially in the City of Denpasar freely crack down on the perpetrators of prostitution.
