Human rights, a reflection for analysis and teaching from a critical perspective

El presente artículo es una propuesta para la enseñanza de los Derechos Humanos desde una perspectiva emancipadora e integral, analizando su desarrollo histórico, como la vinculación de éstos con el Estado moderno, el dispositivo de poder legal, la responsabilidad de la academia y los operadores jurídicos en la distribución desigual de la estructura social, para lograr de construir el paradigma del positivismo en el que se sustenta actualmente. Desde ahí dar las bases para una enseñanza en clave democrática, respetuosa de la heterogeneidad y el pluralismo cultural, que se comprometa con la realidad y la política de la que es parte, y afianzar así el cumplimiento eficaz y efectivo de los Derechos Humanos.This article is a proposal for the teaching of Human Rights from an emancipatory and integral perspective, analyzing historical development, such as the linking of these with the Modern State, the device legal power, the responsibility of the academy and the juridical operators in the unequal distribution of social structure, in order to deconstruct the paradigm of positivism on which it is currently based. From there, to lay the foundations for teaching in a democratic way, respecting heterogeneity and cultural pluralism, committing itself to the reality and the politics of which it is a part, and thus strengthening the effective and effective fulfillment of Human Rights.Facultad de Ciencias Jurídicas y Sociale
