EKSISTENSI DEWAN KEHORMATAN DAERAH DALAM PENGAWASAN TERHADAP NOTARIS DI KABUPATEN SLEMAN (Berdasarkan Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris)

This research aimed to review the position of Regional Honorary Board (DKD) in the regulation of supervision toward notaries in Sleman and analyzed the supporting factors and inhibition that faced by DKD in doing the supervision toward notaries in Sleman Regency. This research is an empirical juridical law research that used secondary data and primary data. The research data came from secondary data which sourced from the library research and primary data which sourced from field research. The way to collect data in this empirical juridical law research is by reviewing secondary data in the first place with literature study that was followed by research on primary data in the field by interview guidelines. The research location conducted in Sleman, Daerah Istimewa Yogyakarta. Sample or research subjects in the research were resource persons and respondents. The sampling technique was done by using non probability sampling. The research results and discussion shows that, DKD is an internal organ of Notary organization so that in case of violation of the code of conduct DKD must be pro-active in taking action against these violations and the supervision institution toward notaries are not only DKD but there are also Supervisory Assembly Institution, both institutions have the same vision and mission in conducting guidance and supervision toward notaries. Based on the research results and discussion that has been done by the writer, it can be concluded that first, the real role of DKD in Sleman district in enforcement and prosecution of violations of notary code of conduct is invisible and particularly the violation that happened was frequently delegated to the Territory Honorary Board or the Regional Supervisory Assembly. Second, supporting factors that support the performance of DKD in Sleman Regency are commitment from notaries to maintain the confidence given by the public, commitment of DKD in performing functional tasks and cooperation with Regional Supervisory Assembly in Sleman Regency while the inhibiting factor of DKD performance in Sleman Regency is budget cost, mutual protection attitude among peers and the absence of a clear administrative system to take actions against notaries who proved to have violated the code of conduct
