Peran Penyidik Dalam Penerapan Konsep Keadilan Restoratif Pada Perkara Kecelakaan Lalu Lintas Di Kota Yogyakarta

In Indonesia, especially The City Of Yogyakarta, there are a lot of vehicles. This matter cause traffic accidents. The investigation did by the investigators involve the offender and the victim. The traffic accidents solution appropriate with Act Number 22 Of 2009. But, after the investigators have a police force�s letter number B/3022/SDEOPS/XII, the investigators finished the traffic accidents based on alternative dispute resolution especially the concept of restorative justice. This research was conducted by using normative and empirical approach. The writer collected the data from literature materials such as books, regulations, journal, and other positive law which are related to the research. Then, the empirical approach is used to collect primary data from the research field. The result of the research shows that the applying concept of restorative justice by the investigator was not maximal. For applying this concept the investigators refer to police force�s letter number B/3022/SDEOPS/XII and there is no regulation that settle the concept of restorative justice for solution of traffic accident yet. This concept is only for the cases of minor traffic accident. This assembling for this concept come from the offender. However, the investigators have a role to be a facilitator for applying the concept of restorative justice in cases of traffic accidents. So far, investigators carry on to evade the criminal justice system to the offender. Although this concept only for specific traffic accidents. At least the investigators already to carry on this concept
