PERLINDUNGAN HUKUM PEKERJA DALAM HUBUNGAN KERJA BERDASARKAN PERJANJIAN KERJA WAKTU TERTENTU DI PT. MULTI GUNA LAKSANA BANJARMASIN

The purpose of this study is to determine The Legal Protection in the Employment Based Agreements in certain time especially the limit of job that can be create in an Employment Agreement and how the dispute settlement case in the working relationship of certain time. This study is empirical legal research. In this research the collecting data, both through library and field research. The research is to obtain secondary data and the field research is to obtain primary data, by collecting data from respondents. The data collections were analyzed with qualitative methods to see the truth in terms of compliance with the measure set specific quality requirements that must be filled. The results of this study concluded, First, Employment Agreement in certain time is not running optimally in the implementation , considering the frequent occurrence of violations, because of the lack of clarity in the application of the rules on working time agreements, particularly with regard to the work time according to the type and nature or the work will be completed within in certain time, the work in once completed or a temporary time, the work completion that expected in short time and not exceeding for two years and extended for 1 year, seasonal jobs or jobs that are related to new products, new activities, or additional products that are still in the experiment. Second, work agreement in certain time or PKWT end with 2 (two) way, that are when the time agreed or exceeded the contracted work or completion of the job, ending before the time and the work is completed when one off the parties want to end it but the parties who end it required to pay compensation to the party who get agreement ended as much as the salary until the expiration of agreement as set out in article no 62 of the labour law
