TELAAH KRITIS PENGATURAN DAN PENGAWASAN SEKTOR JASA KEUANGAN OLEH OTORITAS JASA KEUANGAN BERDASARKAN UNDANG-UNDANG NOMOR 21 TAHUN 2011 TENTANG OTORITAS JASA KEUANGAN

This research aims to know the legal issues contained in the Act Number 21 of 2011 on the Financial Services Authority related to regulatory and supervisory of financial services sector in Indonesia and its implications. This research also aims to know the prospect for implementation of the financial services authority in the future. This research is a normative of juridical research used to 2 methods, there are the literature research by study of literature and the field research by interview with relevant resource persons based on interview guide. Data obtained from the results of research are presented and analyzed in descriptive-qualitative. The results of research showed that there are many legal issues can be learned from the Act Number 21 of 2011 on the Financial Services Authority (OJK) such as : in terms of legal status and independence, accountability system, decision-making, persona standi in judicio, consumer protection, and fee. The Act Number 21 of 2011 on the Financial Services Authority (OJK) gives the implication for scope of OJK�s regulatory and supervisory that includes regulatory and supervisory of microprudential and business conduct for banking and regulatory and supervisory of macroprudential, microprudential, and business conduct for non-banking financial institution, the implication about the transfer of authority, human resources, assets, and documents from Bapepam-LK and BI is done used to 2 steps which is still on going and the implication about amendment of sectoral legislations such as : The Bank of Indonesia Act, The Banking Act, The Islamic Banking Act, The Capital Market Act, The Insurance Business Act, The Pension Fund Act, and The Presidential Rule on Financing Institution. Based on the results research had known that the prospect for implementation of the financial services authority in the future is influenced by many factors including OJK�s efforts in addressing these challenges
