PERANAN DAMANG KEPALA ADAT DAYAK DALAM MENENTUKAN GANTI RUGI TERHADAP SENGKETA HAK ATAS TANAH MILIK MASYARAKAT DI KABUPATEN KAPUAS PROVINSI KALIMANTAN TENGAH

This study aimed to determine the role of Damang As Head of Indigenous Dayak in resolving disputes regarding land compensation and property rights of indigenous peoples based onthe reason of damang verdict which it is valid and binding in the proposed return to the Kapuas District Court. This research is a juridical empirical was based on field research by collecting data directly from study subjects that the Dayak community in the district of Kapuas and the palm oil companies in dispute regarding compensation and was decided by the Damang As Head of Dayak People. Sampling Techniques used was non-probability sampling. Data obtained from both primary data and secondary data were analyzed qualitatively and descriptively presented by outlining and describing the results of research to answer the problem. The results showed that: (1) the role undertaken by the Damang As Head of Indigenous Dayak in terms of determining the compensation for the land property rights that exist in Kapuas District among others receiving a lawsuit from the community, held a commission meeting or check the field, held a session Density mantir / Let Indigenous, making compensation decisions. (2) The reasons for the decision of the Damang As Head of Indigenous which have had the valid that remains in the proposed law back to the Kapuas District Court for ruling a large compensation, proof of ownership is less, the ignorance of the public about legal issues
