TINJAUAN YURIDIS TERHADAP KASUS PENCURIAN IKAN DI WILAYAH KABUPATEN MALUKU TENGGARA

The study was conducted to determine how much the potential of marine fisheries in Southeast Maluku regency, about criminal enforcement of fisheries in Southeast Maluku regency and the role of customary law and / or local wisdom due to preventing perpetrators of illegal fishing. The research in this paper used this type of normative empirical legal research which is located in Southeast Maluku Maluku. Data collection tools used in this study, consists of two types of data namely: Primary Data and Secondary Data. There are several conclusions as result of this research, inter alia, first, crimes in the field of fisheries occures oftenly in Southeast Maluku regency which has the potential of natural resources particularly the marine fishery resources and the enforcement of law conducted seriously evidenced by the number of criminal cases handled fishing and making fishing the criminal sanctions of imprisonment and fines by the institution of law in the jurisdiction of Southeast Maluku regency due to eradicating fishery crimes, second, the existence of the weakness of coordination between investigating agencies and facilities are not adequate to enforce the law in the field of fisheries in Southeast Maluku regency, Third, Local wisdom should be considered especially which is conducted in the Larvul Ngabal as customary law prominently the marine sasi which aims to maintain and preserve the fishery resources in Southeast Maluku regency
