PEMENUHAN KEBUTUHAN NASIONAL LIQUFIED NATURAL GAS (LNG) MELALUI RESTRIKSI EKSPOR DITINJAU DARI THE GENERAL AGREEMENT OF TARIFF AND TRADE (GATT)

This study aimed to analyze the LNG export restriction policy applied by the government of Indonesia known as the Domestic Market Obligations (DMO) in terms of the General Agreement of Tariffs and Trade (GATT), which has been ratified by Indonesia through Law No. 7 of 1994. Especially the provisions of Article XI of the GATT General Elimination of Quantitative Restrictions, Article XX of the GATT General Exceptions and Application of General Most Favoured-Nation-Treatment. This study focuses on the research literature as more reviewing legislation, as well as theories about the concepts and principles of law. However, in some limits, required a variety of data that are informative and justifikatif through field studies. The field study was conducted as required by the type of questions in the formulation of problems that require an answer in the form of perception and analysis of a situation or case relating to the theory of law and the rule of law, such as the principles of the General Agreement of Tariffs and Trade (GATT). From the analysis carried out shows that the DMO policy does not meet one of the elements that set several articles related to the DMO policy, among others, Article XI of the GATT to apply export restrictions, GATT Article XX exceptions to implement the DMO policy, and other articles of the DMO and policies related to equal treatment to other WTO members
