ANALISIS PEMBUKAAN KANTOR CABANG BANK KOMERSIAL DI LUAR NEGERI (STUDI PERBANDINGAN ANTARA INDONESIA DAN SINGAPURA)

The purpose of this research are for comparing the opening mechanism of commercial bank branch offices abroad between Indonesia and Singapore as well as study the norms are used by the respective authority to give permission for foreign commercial bank to open branch offices in his country. This research is a normative research using descriptive analytic methods. The secondary data obtained through the library study, which conducted by finding, collecting and researching library materials related to the title of the research and the subject matter. As a result, this research finds that the procedure for opening the international branch in Indonesia and Singapore has similarities as well as differences. The similarities could be found as in both countries, bank ranks and provisions rating are essential as part of the requirements. However, while Singapore already has published rigid requirements for it, in Indonesia provisions rating and bank ranks is only listed in Decision Letter of the Board of Directors Bank Indonesia No. 32 / 37 / KEP / DIR the date of May 12 Year 1999 about Requirements and the Procedures of an Opening of Branch Office, Supporting Branch Offices, and representative offices from the bank that domiciled abroad. Further, technically Bank Indonesia emphasized in feasibility study and prospect of the bank instead of bank ranks/rating which happens in Singapore. There is no certain norm which underlies the granting of permission to the opening of branch offices of foreign banks in Indonesia. The granting of permission by Bank Indonesia would assess the feasibility studies and highlights of the opening of an office in Indonesia. Bank Indonesia emphasizes on the ability of the bank related to preparatory and reporting financials. Bank Indonesia encourages Indonesian commercial banks to analyze its abilities better before expanding abroad. The reciprocal principle served as the basis for one country to obtain equal treatment in determining the status of the international network of Indonesian commercial bank abroad
