IMPLIKASI YURIDIS HILANGNYA SERTIFIKAT HAK TANGGUNGAN DALAM PROSES ROYA

The study concerning juridical implication of the loss of insurance right certificate in the Roya Process aims to find out how the juridical implication from the loss of insurance right certificate in the roya process and how the roya implementation regarding the loss of insurance right certificate in the Roya process in the Land Affairs Department of Pekanbaru City. This study use empirical juridical law that is an approach towards problems by seeing and observing the valid law norm connected with the existing phenomenon from the problems which was found in this study. The data collection method using field study linked with the law principle completed with library study. This study employs direct communication contact by using guided interview. The data analysis was done qualitatively and served descriptively. Based on the study, the juridical implication of the loss of insurance right certificate in Roya process is that the giver party of the insurance right (debtor) can not execute the insurance right of the roya process in the local Land Affairs Department and the debtor can not prosecute because the certificate of the land is still being burdened by insurance right. Whereas the roya implementation related with the loss of insurance right certificate in Roya process principally the Land Affairs Department of Kotabaru City in performing the duty to serve the society is still guided by the valid stipulation, the implementation of the insurance right eliminating request related to the loss of the insurance right certificate is appropriate as the general rule. If the insurance right certificate is lost, then the additional document as the substitute of it is done by making the roya konsen certificate and as long as the entire document is still complete, it will be proceed as the valid procedure
