KAJIAN TERHADAP PUTUSAN PENGADILAN NEGERI SURAKARTA NOMOR 143/PDT.G/2005/PN.SKA TENTANG PEMBATALAN HIBAH DIKAITKAN DENGAN ALIMENTASI ANAK BERDASARKAN KITAB UNDANG-UNDANG HUKUM PERDATA

This study aims to determine the legal effect the cancellation of grants related to alimony and child against a parent based on the civil code and accountability Official land deed maker who makes a grant to the cancellation of the deed of grant by the number 37 in 1998 of government regulations about Official land deed maker. This research is a normative juridical studies with non-random sampling technique of sampling and type of sampling used was purposive sampling. subjects in this study were two judges in Surakarta court�s,two people from official land deed maker, one person academics and one person official land deed maker from Klaten. qualitative research data is analyzed and presented in a descriptive analysis. Due to the cancellation of the grant is the return of legal ownership rights to object to the grant recipient of grants from the grantor. As for the relation to the child's parents alimony is based on paragraph 3 of article 1688 civil code which implies an obligation to the child as a grant recipient as the donor parent. paragraph 3 of article 1688 Civil Code states that � a grant inalienable and therefore can not also be canceled, except if the grantor impoverished, were given a grant have to refused to give him a living. Official land deed maker liability as the official who made the cancellation of the grant deed is a deed of grant with respect to all the contents of the deed is made, where accountability is concerned with the formal and material accountability. if the matter relating to the implementation of the grant deed, the PPAT deed as official grant maker, free from responsibility as it relates to behavior and good faith of the parties to implement the grant
