PERLINDUNGAN BAGI INVESTOR DALAM MENUNTUT PERTANGGUNGJAWABAN TERHADAP EMITEN YANG TIDAK MELAKUKAN KETERBUKAAN INFORMASI

This research is intended to find out information that can be categorized as material fact information, the form of legal protection for investors as those who invest in the stock market, and the legal consequences if the issuer does not undergo a disclosure of information to investors in research on protections for investors in demanding accountability of the issuers that do not disclose information. Research methods used in this thesis is a combination of normative juridical approach and empirical juridical approach methods. The type of data sought is the primary data. Data collection techniques used is library research by collecting and reviewing regulations, legal theories and the various references to answer the issues which are raised in this thesis, and field research in collecting the data which are directly obtained from their sources. From this research, it can be seen that the Issuers are obliged to convey all information or material facts to the public about their business conditions and categories of information or material facts as long as the information may affect the price of securities on stock exchanges and or investors� decision. Example of information or material facts is mentioned in the explanation of Article 1 of item 7 of the Capital Market Law and Bapepam Rule No. X.K.I. regarding Information Disclosure That Must Be Made Public. The law of protection for investors who suffered losses due to the fact that issuers do not disclose of information by demanding compensation from the violation of their right to get information, so that issuers that do not disclose the information are subject to administrative sanctions and criminal sanctions by the Bapepam and the legal consequences for issuers that do not disclose the information is the sanction in accordance with Article 102 of the Capital Market Law and the magnitude of sanctions is stipulated in the Government Regulation Number 45 Year 1995 Concerning Capital Market
