TANGGUNG JAWAB NOTARIS TERHADAP AKTA YANG DIKELUARKAN OLEH NOTARIS PENGGANTINYA DI WILAYAH KOTA BANJARMASIN

This research aims to determine the constraints or difficulties faced by a notary to appoint a subtitute notary and to determine the responsibility of a notary regarding the authentic deed that issued by the subtitute notary. This thesis is conducted by the way of juridical empiric. The data used in this research is secondary data that obtained from library materials through the study of documents supported by primary data, such as data obtained directly from the field by using a data collection tool in form of structured or unstructured interview. The data�s collected were analyzed qualitatively and made in the form of descriptive research reports. The result of this research, indicating that the responsibility of a notary regarding the deed that issued by his/her subtitute notary in the area of the city of Banjarmasin is morality. A notary is morality responsible for all the authentic documents issued by the subtitute notary. But for criminal responsibility, which negligence may be committed by a subtitute notary, may result in self responsibility of the related subtitute notary, because the notary who subtituted will not be willing to share responsibility for a negligence which resulted in a criminal act. Obtacles or difficulties in appointing a subtitute notary is the lack of resources and employees who are prepared to become an assistant and / or later can be appointed at any time during the notary is filed on leave
