PENYELESAIAN SENGKETA TANAH ADAT DAN HAK-HAK ADAT DI ATAS TANAH MASYARAKAT ADAT DAYAK DI KECAMATAN KAPUAS HULU KABUPATEN KAPUAS

The objective of this is to find causal factors of disputes of customary land rights to Dayak legal community land study, sub-district of Kapuas Hulu. Other objective is to understand and study dispute resolution of the customary community land and rights to the Dayak�s customary community land, Sub-district of Kapuas Hulu. This research is juridicial-sociological study, a legal study seeing law as social phenomenon or institution. Main data of this research is primary data and supported by secondary data. The collected data are analyzed qualitatively. Reseach subjects consist of respondents, namely, those who disputed. In addition, informants supported research data by giving information on researched problems, such as, Chief Customary Board of Province, Chief Customary Board of Regency, Damang Kepala Adat, and team members of the local Government. Result of research indicate that causal: 1). factors of disputes of customary community land and rights to customary community land in Dayak, Sub-district of Kapuas, are: a. taking-over of customary land, customary forest destruction, and customary rights to land, b. disrespecting and ignoring Customary Law, c.compensation, d. claim of each party as Perwatasan Land Owner, e. Border Movement. 2). Dispute settlement of customary land and rights is made through Damang Kepala Adat, Local Government and Court
